Opinion | ICE told agents they can enter homes without a judicial warrant — and hid it from the public

A leaked memo from Immigration and Customs Enforcement (ICE) reveals that agents have been authorized to conduct home invasions without judicial warrants, raising serious concerns about the erosion of civil liberties and the rule of law.

For years, Republican politicians have used inflammatory rhetoric to describe undocumented immigrants as "invaders" who are trespassing on private property. However, this language is hypocritical when applied to ICE agents who are breaking into homes without warrants. The memo's revelation that these invasions were intentionally hidden from the public highlights the emptiness of GOP claims to oppose "invasions" and "trespassing."

The use of the term "invasion" by Republicans is a specious argument that has always been overblown and dangerous. Immigrants who are working in this country, whether legally or not, are hardly "invaders." They live in their own homes on private property, just like anyone else. The leaked memo shows that some Republican politicians were using this rhetoric to justify violent actions against immigrants.

The GOP's official platform denounces the "Migrant Invasion," which was a key part of Trump campaign ads in 2024. However, when it comes to ICE agents invading homes without warrants, the party is silent. This hypocrisy is particularly disturbing given that nothing is more sacred in American law than the sanctity of the home.

The Fourth Amendment, enshrined in the US Constitution, prohibits police from making warrantless and nonconsensual entries into a suspect's home. Even in cases where there may be probable cause to arrest someone, a warrant must be issued by a judge before an entry can be made.

The Department of Homeland Security has official training materials that explicitly state that entering a home without a warrant or exception is typically a violation of the Fourth Amendment. The relevant warrant must be issued by a judge.

Given the severity of this breach of civil liberties, it's no wonder that ICE hid the memo from the public for months. However, this policy change has now been exposed, and its implications are far-reaching.

Just last month, an ICE agent entered the home of ChongLy Scott Thao, a US citizen, in St. Paul, Minnesota. Thao reported that he was shaken when agents broke down his door without showing him any warrant. His 4-year-old grandson even cried as Thao was led out of his home wearing sandals and underwear.

Another family in Minnesota with children inside the home had their door smashed down by DHS agents using a battering ram, but they were told that there wasn't a warrant signed by a judge. Agents arrested a Liberian immigrant father without showing him any documentation.

The leaked memo shows that these invasions are not isolated incidents. For months, I have been tracking dozens of instances where ICE and DHS agents entered private property without warrants.

It's hard to overstate the gravity of this situation. In a free country, it's essential for the executive branch to seek permission from a neutral party to enter our private spaces — showing probable cause of a violation of the law.

There is an inherent difference between immigrants crossing the border illegally and ICE agents entering homes without warrants. The former have no path to enter the United States legally, whereas the latter can obtain a warrant based on probable cause.

This new policy change has made Trump the leader of the pro-invasion party now. It's essential for Americans to be aware of this reality and demand that their elected officials take action to stop these unconstitutional invasions.

The moment when DHS agents jumped over the fence outside a US citizen's home in Chicago last October was like something out of a movie. The imagery couldn't have been more on point. For DHS, immigrants are "invaders" who require a military-style response when they go over or around barriers to request asylum. But when their own agents violate the Constitution by breaking into private homes without warrants, it's not an invasion.

As this situation continues to unfold, one thing is certain: the notion that government agents can enter our homes without judicial warrants will be met with widespread outrage and resistance from Americans who value civil liberties and the rule of law.

🚨 The fact that ICE agents were authorized to break into homes without warrants is a huge blow to the rule of law and civil liberties in the US. It's insane that politicians like Trump used inflammatory rhetoric about "invaders" while their own agents are doing exactly that. 🤯 This hypocrisy is unacceptable, especially when it comes to something as fundamental as the sanctity of the home.

The Fourth Amendment is clear: no warrant, no entry. Period. And yet, DHS agents are explicitly trained not to enter homes without a warrant or exception. It's like they're trying to justify their actions while pretending that immigration and law enforcement are separate issues. 🙄

These invasions are not just a problem for immigrants; they're a threat to everyone's right to privacy and security in their own homes. We need to hold our elected officials accountable for this blatant disregard for the Constitution and demand action to stop these unconstitutional invasions. 💪

🚨 I'm still reeling from what I read about ICE's memo on home invasions without warrants. This is a huge breach of trust and a clear disregard for the Constitution 🤯. How can we justify calling immigrants "invaders" when our own agents are doing the same thing? The GOP's hypocrisy is staggering, especially given their stance on immigration. We need to hold our elected officials accountable for this unconstitutional policy change 👊. I'm so glad someone finally exposed the truth behind these secret invasions 📣. It's time for a national conversation about what it means to be an American and how we value our civil liberties 💬

this is wild 🤯, how did they get away with this for so long? it's like they're saying that as long as you're an undocumented immigrant, you don't have rights 🚫, but if you're a US citizen, suddenly those rights don't apply anymore 🤷‍♀️. and the GOP is just standing by, silent as can be 🗣️, it's like they're complicit in this whole thing 👀. what's next? 😱

lol what a total abuse of power 🤯, like seriously who gives ICE agents a free pass to break into people's homes w/o warrants? It's not even about "invasion" anymore, it's just plain old fashioned creepiness 😒. And btw, isn't it rich that the GOP is all like "opposing invasions" when they're secretly letting their minions run amok 🙄. This memo has been hiding in plain sight for months and now everyone's all like "wait what?" 🤷‍♀️

OMG, can u believe what's going on?! 😱 they're literally breaking into ppl's homes without warrants! like, what even is the point of having a country if we can't trust our own government agents to follow the rules? 🤯 the fact that they were hiding this from the public for months is just wild... it's like, hello, we need to know what's going on in our own homes! 🏠🚨 and btw, how is this not a huge issue when republicans are always talking about "invasions" but now they're all quiet about it? 🤔 it's just so hypocritical...

😱 I'm literally shook by this news! Like, how can we trust our own government when they're doing this? It's like a whole different level of hypocrisy when it comes to Republicans talking about immigration and then having ICE agents break into homes without warrants. The fact that they were hiding it from the public is wild 🤯. We need to hold these politicians accountable for their actions, especially when it comes to our civil liberties. I mean, what's next? Breaking and entering by police officers everywhere?! 💥 This policy change is a serious threat to our democracy and we can't just sit back and do nothing about it. We need to speak out and demand that our elected officials take action to stop these unconstitutional invasions. 🙌

I'm so worried about what's going on with ICE and DHS 😱. They're basically saying they don't need a warrant to break into people's homes, which is just crazy talk 🤯. I mean, come on, our homes are supposed to be safe spaces, right? The fact that politicians like Trump are using the same rhetoric for their own agents as they do for immigrants is just hypocritical and sad 😔.

I'm also thinking about all those families who have been affected by these home invasions - ChongLy Scott Thao's family, for example. It must be terrifying to come home to find your door broken down by agents in sandals and underwear 🤢. And what about the kids? I can only imagine how traumatizing it must be for them.

We need to make some noise about this ASAP 💬. Our elected officials should be ashamed of themselves for standing by while this happens. The Fourth Amendment is in place for a reason, and we shouldn't let our politicians just ignore it 🙄.

IT'S ABSOLUTELY DESPICABLE THAT ICE AGENTS ARE CONDUCTING HOME INVASIONS WITHOUT JUDICIAL WARRANTS!!! THIS IS A CLEAR VIOLATION OF THE 4TH AMENDMENT AND CROSSES EVERY LINE OF CIVIL LIBERTIES!!! REPUBLICANS WHO HAVE BEEN SELLING OUT IMMIGRANT RIGHTS AS "INVASION" LANGUAGE NEED TO GET REAL - WE'RE TALKING ABOUT PEOPLE'S LIVES HERE, NOT SOME INVASION MYTH!!! 🚫👮‍♂️ THIS IS A DARK DAY FOR AMERICA AND WE SHOULD ALL BE FIGHTING AGAINST IT!!!

I'm literally shocked 🤯 by the news about ICE agents breaking into homes without warrants. I mean, what's next? Police showing up unannounced at your doorstep with guns drawn over a minor infraction? The whole idea of the Fourth Amendment is to protect our homes and personal space from arbitrary government intrusion.

The GOP's stance on "invasion" seems like a total cop-out 🤥 when it comes to their own agents' actions. It's not about immigration, it's about civil liberties and respect for individual rights. I've got kids who are still in school and they have no idea what's going on behind closed doors... or rather, open doors without warrants 😱.

We need to hold our elected officials accountable for this blatant disregard for the Constitution. As a parent, it's terrifying to think about what would happen if someone like that came to my door uninvited 🚪. I'm all for securing our borders and enforcing immigration laws, but not at the expense of our basic human rights.

It's time for Trump to admit he was wrong on this one 😒. The party needs to take a stand against these unconstitutional invasions before it's too late. We can't let our elected officials turn a blind eye to this erosion of civil liberties 🚫.

I was just at my favorite coffee shop yesterday and I saw the cutest puppy with a little coat on 🐶. It made me think, have you ever noticed how dogs can sense when we're feeling stressed or anxious? My friend's dog always snuggles up next to her when she's having a bad day. It's so cute! Anyway, back to this news... I don't think it's right that ICE agents are getting away with breaking into homes without warrants. It's like they're above the law or something 🤯. And what's with the whole "invasion" thing? Can't we just call them human beings who want a better life? 🌎

😱 are we living in a country where gov't agents think they're above the law? 🤯 an invadion w/o warrant is just as bad as someone trespassing on ur land. what's next, them breakin into our homes while we r watchin our kids play outside? 🚫 this memo exposez the real face of the gop and their so-called anti-invasión rhetoric. it's all about controllín' people w/o a warrant or probable cause. 👮‍♂️🚔 this is some crazy stuff and i'm not sure if americans r ready for it yet 😳

omg what a nightmare 🤯 i was just thinking about getting a pet rabbit the other day and i saw this ad for someone giving away a bunch of free plants in their neighborhood. like, why not? free plants are always welcome 🌱👍 anyway back to ice and customs... can we talk about how they're basically wearing two hats at once? first they're all like "us citizens have rights" but then it's revealed they're breaking the law just as badly

I'm soooo behind on this thread lol 🤦‍♂️ what's going on here though? It sounds like ICE is literally breaking the law by entering people's homes without warrants? Like, I get that they're trying to enforce immigration laws, but come on! This whole thing with Trump using "invasion" rhetoric and now having his own agents do the opposite is just wild. And what's up with DHS hiding this memo from the public for months? Transparency is key, guys! 🤝

Wow 😱 just how low are we as a country when our own agents are breaking the law like this? And to think it's been going on for months, no one even knew 🤯. This is not about immigrants or invaders, it's about basic human rights and the rule of law. The GOP needs to get their act together and speak out against this blatant disregard for civil liberties 👊

🤕 I'm really worried about this leaked memo, it's like they're completely disregarding our rights as citizens 🙅‍♂️. I mean, can you imagine if this happened to anyone in your family? The Fourth Amendment is there for a reason, and it's not just some old law on the books - it's about protecting us from abuse of power 🔒. We need to stand up against this and demand that our leaders take action to stop these unconstitutional invasions 💪. It's not right to say one thing in public and do another when no one is watching 🤥. This whole thing just feels like a big hypocrisy fest, and I'm not sure how much more of it we can take 😩

😱🚫 just think about what kind of message this sends to people living in fear of being suddenly invaded by ICE agents... like ChongLy Scott Thao's story, where his 4-year-old grandson even cried 🤯... it's not an invasion when you're a US citizen, right? 🙅‍♂️ we need to hold our elected officials accountable for this huge breach of civil liberties 💪

🚨 This whole thing is just crazy 🤯. I mean, we've been hearing about "immigrants invading" for years, but it's always been a total load of hype 🙄. And now this memo comes out showing that our own ICE agents are doing the exact same thing? It's like, come on guys, get some consistency in your rhetoric already 😂. This isn't just about immigrants or Republicans, it's about what happens when we start to erode civil liberties and the rule of law. That's a whole different can of worms 🐜.

I'm still trying to wrap my head around this one - our government agents are basically saying that they don't need a warrant to break into someone's home because they think their job is more important than following the law 🚫. Like, what even is the point of having a Constitution if we're just going to ignore it? 🤷‍♂️ The Fourth Amendment is there for a reason, folks - it's not up for interpretation by politicians or bureaucrats.

And don't even get me started on the hypocrisy 😒. Republicans are always talking about how they're all about "law and order", but when it comes down to it, they're just as bad as the people they claim to be fighting against 👊. We need to start holding our leaders accountable for this kind of behavior, or else we're going to lose everything that makes America great 💔.

Anyway, I'm gonna keep following this story and seeing how it all plays out 📰. Wish me luck 😂!
